1. General Provisions and Validity of the Terms of Use

1.1. The terms and conditions of the e-shop apply to purchasers who use the website www.airmarket.ee (hereinafter referred to as „Airmarket.ee”) and purchase goods from the e-shop. The owner of the e-shop and the contracting party to the sales contract is Baumarket OÜ (registration code 14989581), located at Rävala pst.6, 4th floor, 10143 Tallinn, Estonia (hereinafter referred to as "Baumarket OÜ"). The e-shop sells goods only to buyers who are natural persons (hereinafter referred to as the "Customer"). Legal persons are kindly requested to consult the Baumarket OÜ business customer information leaflet and contact the Airmarket.ee business customer manager. If goods are purchased from the e-shop by a legal person, these terms and conditions do not apply to such a transaction.
1.2. The Terms and Conditions of Use shall not be in conflict with the laws and regulations in force in the Republic of Estonia and, if necessary (in case of disputes or missing information), these provisions shall be supplemented.
1.3. If a purchaser who is 16- to 18-years of age or of limited legal capacity purchases goods from the e-shop, Baumarket OÜ assumes that the purchase has been made with the consent of a legal representative or with funds given to the purchaser for free use by the purchaser's legal representative.

2. Price List

2.1. In addition to these Terms of Use, the relationship between the Customer and Airmarket.ee is governed by the Price List and established good practices.
2.2. Internet shop Airmarket.ee reserves the right to unilaterally amend these terms and conditions and the price list for the purpose of efficiency, competitiveness, future development, supplementing or reorganization of its services and goods assortment. For example, Baumarket OÜ has the right to set a minimum and/or maximum order quantity for a specific product in the case of an individual order. In addition, Baumarket OÜ reserves the right to withdraw from the sale of ordered goods in the following cases:
1.5.1. if the price or characteristics of the goods are not correct due to human error or technical problems in the e-shop system;
1.5.2. the ordered goods are not in stock;
1.5.3. the purchaser does not comply with the requirements of these terms and conditions.
1.6. Changes and amendments to the terms and conditions and the price list shall enter into force as of the date of publication of this information on the website www.airmarket.ee. If the Customer submits his order before the entry into force of the amendments to the Terms and Conditions, the Customer shall be subject to the terms and conditions in force at the time of submitting the order, unless otherwise provided by law or these Terms and Conditions. The amendments shall not apply retroactively.
2.4. Baumarket OÜ and the Customer wish to trade via the Airmarket.ee website www.airmarket.ee on the terms and conditions set out herein. Airmarket.ee by placing an order online and paying in advance,
the customer confirms that he/she has read and agrees to the Terms of Use, including the personal data processing procedures set out in the Terms of Use.
1.7.1. Baumarket OÜ shall keep the terms and conditions of the sales contract concluded with the buyer on a durable medium.
1.7.2. Baumarket OÜ will forward the order confirmation and the terms and conditions of the sales contract to the e-mail address published by the buyer.

3. Order Placement and Payment for the Goods

3.1. It is possible to use the e-shop as a non-registered user or as a registered user by creating a Airmarket.ee e-shop account.
3.2. To place an order, you must fill in the predefined fields: payer and delivery details, delivery method, agree to the terms of use and then select the payment method.
3.3. Payment of the order can be made by bank transfer (Coop Pank, Swedbank, SEB, LHV Pank, Luminor või Citadele), by Visa / MasterCard payment cards, by bank transfer to the bank account of Baumarket OÜ in the amount of 100% of the prepayment amount according to the order invoice submitted or with in several instalments.
3.4. Baumarket OÜ's official payment solution provider for both bank links and bank card payments is EveryPay AS, through whose payment environment the payment is normally made as instant payments or SEPA clearing cycles. The recipient of the payment is Baumarket OÜ. EveryPay AS is not a party to the sales contract between the buyer and Airmarket.ee.
3.5. Payment for the order must be made immediately. The order shall be deemed to be placed upon payment for the goods.
3.6. The Buyer has the possibility to apply for instalment payment for purchases by clicking on the corresponding instalment payment icon in the Airmarket.ee webshop. To make a request You will be automatically redirected to the website of the service provider to submit the corresponding application and additional documents. 
3.6.1. For the purchase of goods by instalment, the terms and conditions of the service providers displayed on Airmarket.ee will apply. 
3.7. The contract for the sale of the products shall be deemed to be concluded (entry into force of the Contract) as of the date of receipt of the amount due according to the order confirmation in the current account of Baumarket OÜ.
3.7.1. Baumarket OÜ asks buyers to make sure that the information provided in the order confirmation is correct and, subject to the terms and conditions, to keep it together with the terms and conditions of the e-shop until the end of the period for lodging complaints (24 months).
3.8. Orders placed in the e-shop will be processed on working days (see "Contacts" for more information). If the order is placed later than 15:00 on a Friday, it will be processed on the following Monday. The same applies to the "Pick-up from dispatch" delivery note.

4. Availability and Delivery of Goods

4.1. Goods ordered from the e-shop can be delivered by the delivery method of your choice, which is displayed in the shopping cart.
4.2. Collection from the point of delivery:
4.2.1. The requested goods or order will be delivered to the dispatch point of Baumarket OÜ usually within 1-5 working days. The Customer will be notified by telephone, e-mail and/or SMS when the goods are ready for dispatch, after which the ordered goods must be collected within 7 (seven) working days at the latest.
4.2.2. The Goods shall be delivered only to the Buyer or to the person authorised by the Buyer. In order to receive the goods, the Buyer must present the order number and an identification document, without which Baumarket OÜ has the right to refuse delivery of the goods.
4.2.3.  If the order cannot be delivered at the time indicated, the Customer must inform the Customer Service team in writing by e-mail: info@airmarket.ee. If the terms and conditions are not met, the Baumarket OÜ team has the right to cancel the order and return the goods to the warehouse.
4.3. Delivery of goods by courier to the requested address:
4.3.1. By selecting courier as a suitable delivery method, the ordered goods will be delivered to the selected address usually within 1-5 working days.
4.3.2. The price of the "Delivery by courier" option depends on the total weight of the goods/item and the delivery zones, see „Delivery“ for more information.
4.3.3. In case the delivery of the goods is not possible within the agreed time, Baumarket OÜ has the right to extend the delivery time by informing the buyer immediately.
4.3.4. If the buyer loses interest in the ordered goods due to the extended delivery time, the buyer has the right to withdraw from the submitted order by informing Airmarket.ee customer service by e-mail info@airmarket.ee. If the buyer paid for the goods and transport when placing the order, the buyer will be refunded the cost of both the goods and the courier service upon cancellation of the order.
4.3.5. Upon receipt of the goods, the buyer undertakes to immediately check the quantity of the goods and their conformity with the order and to sign the delivery note. If the Buyer notices on receipt of the goods that the goods do not correspond to the order, the data stated on the delivery note or that the packaging and the goods are substantially damaged, the Buyer has the right to refuse to accept the goods and to return the goods to the courier.
4.4. Delivery to a parcel machine:
4.4.1. For the delivery of goods of small volume and size, we recommend the Customer to use the parcel machines located at the shopping cart checkout.
4.4.2. The delivery time to the parcel machine is normally 1-3 working days, depending on the workload and workload of the logistics companies and retail or wholesale warehouses.
4.4.3. The Customer will be notified of the arrival of the Parcel by SMS and will also be provided with the parcel code as requested.
4.4.4. See „Delivery“ for further information.
4.5. Special transport, i.e. transport of non-standard goods/items:
4.5.1. Special delivery applies automatically to goods with a longest side exceeding 3m or if the total weight of the order exceeds 600 kg (e.g.. 1 tonne mixtures, paving stones, blocks, longer timber products and other heavy products).
4.5.2. We encourage Customers to order special transport for goods whose transport requires special handling or handling according to their dimensions, volumes or non-standard characteristics to the desired destination. For example, the transport of heavy and/or non-standard consignments is recommended to be ordered by special transport, the delivery and unloading of which requires guaranteed delivery to the address indicated by the consignee.
4.5.3. The price of the option "Special transport or transport of non-standard goods/items" will be calculated in the shopping basket according to the total weight of the order and the final destination of the shipment, except for islands, where the Customer Service team will quote a separate price for the transport service.

5. Cancellation of Order and Return of Product

5.1. The Customer has the right to withdraw from the sales contract concluded in the e-shop and return the goods purchased from the e-shop within 14 (fourteen) days from the date of receipt of the goods. In order to return the goods, the Customer must fill in the withdrawal form (in WORD-format) or send a free-form written request to Customer Service either by e-mail to info@airmarket.ee or to the contact address, see „Contacts“.
5.2. The notice of withdrawal must state:
5.2.1. the number of the order or invoice from which the withdrawal is requested;
5.2.2. the date of receipt of the goods or consignment;
5.2.3. the buyer's contact details (first name, surname, contact telephone number);
5.2.4. the exact name of the goods to be returned;
5.2.5. the exact reason for returning the goods, if requested, in order to continuously improve the quality of goods and services resold by Baumarket OÜ.
5.3. The right of withdrawal does not apply if the buyer is a legal person.
5.4. The goods to be returned must be unused and it is the responsibility of the buyer to ensure that the depreciation in value of the goods has not been caused by any means other than to ascertain the nature, characteristics and performance of the goods. If the goods have been used for any other purpose, i.e. not in accordance with the terms and conditions, Baumarket OÜ has the right to reduce the refundable amount in accordance with the reduction in value of the goods.
5.5. The customer must return the goods within 14 (fourteen) days of the date of the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.
5.6. The deposit for the cancelled order (excluding the return transport costs) will be refunded to the Customer's bank account within 14 (fourteen) days after the submission of the application to the e-mail address info@airmarket.ee, provided that the goods are returned to the Baumarket OÜ warehouse within this period.
5.7. The Customer shall bear the entire cost of returning the goods, except for clause 5.8.
5.8. Baumarket OÜ shall bear the costs of returning the goods if the goods are damaged, which could not be detected on external inspection and which did not occur when the packaging was opened, or if the goods do not correspond to the product ordered by the Customer (i.e. the wrong product).
5.9. If the product or packaging to be returned has been damaged and this situation has been caused by the Customer as a result of improper use, rebuilding or improper assembly or disassembly of the product, or as a result of circumstances due to the fault or negligence of the Customer, Baumarket OÜ reserves the right to offset the reduction in the value of the product against the amount paid by the Customer for the goods and due for return, and not to pay the transport costs associated with the return of the goods. In the event that the Customer does not agree with the depreciation indicated in the offsetting, the Customer has the right to have the depreciation of the returned product assessed by an independent expert in order to determine the depreciation or to identify the person responsible for the situation.
5.10. In case the Customer loses interest in purchasing the product due to a longer delivery period, the Customer has the right to cancel the order by sending a request to the address info@airmarket.ee. The advance paid by the Customer will be refunded within 14 (fourteen) days from the date of the Customer's request.
5.11. Baumarket OÜ reserves the right not to cancel the Customer's order and not to accept the returned goods if the purchased materials were specially ordered for the Customer on the basis of a special order. A special order is deemed to be:
5.11.1. special products specially ordered from the manufacturer for the Customer, which have been ordered on the basis of the Customer's special request and which do not appear in Baumarket OÜ's standard assortment;
5.11.2. bulk orders which are placed after a sample has been sent and approved by the Customer.
5.12. Baumarket OÜ reserves the right to cancel the Customer's order if:
5.12.1. the ordered goods are out of stock at the supplier's warehouse and the Customer does not agree to a replacement product offered by Baumarket OÜ;
5.12.2. no advance payment has been received to the Airmarket.ee bank account for the fulfilment of the order;
5.12.3. the price or characteristics of the goods are not correct due to human error or technical problems in the e-shop system.

6. Claiming Conditions

6.1. Pursuant to the Law of Obligations Act, the period for filing a claim for products purchased from the e-shop is 2 years from the date of receipt of the goods. The customer has the right to lodge a claim for non-conformity with the terms of the contract in the event of defects in the goods. In the case of a defect occurring within the first twelve months, i.e. within the first year, it is assumed that it was present at the time of purchase and the nature of the defect must be determined by Baumarket OÜ.
6.2. In the event of a defect in the product, the customer undertakes to notify Baumarket OÜ Customer Service of the problem by e-mail to info@airmarket.ee to provide the following information in writing:
6.2.1. the name and details of the contact person;
6.2.2. the defect of the product (description of the defect, if possible photos);
6.2.3. the number of the order or purchase document.
6.3. The claim must be sent no later than 2 (two) months after the discovery of the defect. In the event of a defect in the product, the installation/use of the material should be stopped immediately and the customer service of Baumarket OÜ should be informed immediately in case of a defect. Upon expiry of the aforementioned period, the customer loses the right to request Baumarket OÜ to repair or replace the product free of charge.
6.4. Complaints will be examined and the buyer will be contacted as soon as possible, but not later than 15 (fifteen) days from the receipt of the complaint. In the event of replacement of defective goods, Baumarket OÜ shall have the right to demand the return of the defective goods from the customer. Baumarket OÜ shall bear the transport costs related to the replacement of the product. Compensation shall not be granted for the installation or restoration of defective products.
6.5. The customer may only claim a refund if the repair or replacement of the product is not possible or fails, or in the following cases Baumarket OÜ unjustifiably refuses to repair or replace the product, or fails to do so within a reasonable time after the complaint has been lodged, or if the repair or replacement of the product causes unreasonable inconvenience to the customer.
6.6. Not subject to complaint:
6.6.1. instruction in the use of the product, adjustment, maintenance, cleaning, restoration to a commercial appearance and repair of defects caused by failure to comply with the instructions for use.
6.7. Baumarket OÜ is liable for non-conformity and defects of the goods if the non-conformity existed at the time of delivery of the goods to the buyer.
6.8. Baumarket OÜ shall not be liable for defects in the Goods caused by the Customer itself due to improper or inappropriate installation, use and/or maintenance of the Goods. In addition, Baumarket OÜ shall not be liable for defects in the goods which have arisen as a result of normal/natural physical wear and tear of the goods.

7. Dispute Resolution

7.1. Disputes shall be settled in accordance with the law of the Republic of Estonia. Baumarket OÜ's liability for damages is limited to an amount equal to the purchase price of the goods which caused the damage to the buyer.
7.2. Disputes between the Buyer and Baumarket OÜ shall be settled by negotiation. If Baumarket OÜ has refused to satisfy the buyer's complaint or if the buyer does not agree with the solution offered by Baumarket OÜ and considers that his rights have been violated or his interests have been harmed, the buyer may lodge a complaint with the Consumer Disputes Committee (at Pronksi 12, 10117 Tallinn or by e-mail at avaldus@komisjon.ee) or with the court. 7.3. In addition to the above, the purchaser has the right to use the Online Dispute Resolution (ODR) platform http://ec.europa.eu/odr. to settle any dispute arising from goods or services purchased from the online shop. The ODR platform is primarily intended for cross-border disputes, allowing the purchaser to more easily find the appropriate out-of-court entity in the trader's Member State to settle a specific dispute.

8. Liability and Force Majeure

8.1. Baumarket OÜ shall be liable to the Customer for any damage caused by Baumarket OÜ in breach of these Terms and Conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.
8.2. The Customer shall be liable to Baumarket OÜ for any damage caused by the Customer's breach of these Terms and Conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.
8.3. Neither party shall be liable for the other party, and its conduct shall not be considered a breach of any of its obligations under these Terms and Conditions. The performance of any of these Terms and Conditions shall not be deemed to be a breach of these Terms and Conditions by reason of any delay in performing any of its obligations or any failure to perform any of its obligations if the cause of such delay or failure was beyond the reasonable control of that party (force majeure).
8.4. Baumarket OÜ will not compensate the Customer for any moral damages that may be caused by changes in delivery times, prices and other conditions under these Terms and Conditions.
8.5. Baumarket OÜ will not compensate the Customer for any costs incurred by the Customer as a result of the Customer assuming obligations to third parties (other than Baumarket OÜ) under terms and conditions that are inconsistent with these Terms and Conditions.
8.6. Baumarket OÜ shall not compensate the Customer for any unused opportunities arising as a consequence of changes in delivery times, prices and other terms and conditions.

9. Direct Marketing and Processing of Personal Data

9.1. Baumarket OÜ processes the personal data provided by the buyer in accordance with the requirements of the Personal Data Protection Act.
9.2. Baumarket OÜ uses the personal data provided by the buyer (including first and last name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. Baumarket OÜ does not transfer, sell or disclose the buyer's data to third parties without the user's prior consent or in cases provided for by law. Baumarket OÜ transfers personal data to companies providing transport services in order to deliver the goods.
9.3. Baumarket OÜ will send newsletters and offers to the buyer's e-mail address only if the buyer has expressed his/her wish to receive such newsletters and offers by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications.
9.4. The Buyer may opt out of receiving offers and newsletters by e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
9.5. The Buyer has the right to access his/her personal data at any time and to request the correction, blocking or deletion of such data, except where otherwise provided by law.

10. Licensing and Intellectual Property Rights

10.1. The copyright in the photos, texts and other works of the Airmarket.ee e-shop belongs to Baumarket OÜ or its partners.
10.1.1. The photographs of the product are illustrative.
10.2. The use of Airmarket.ee e-shop photos, texts or other works protected by copyright for commercial purposes is not permitted. The name, logo and graphic images of Airmarket.ee may be registered trademarks, the use of which is subject to the consent of Baumarket OÜ.
10.3. The prices and availability of products are subject to change without notice.
10.4. The Airmarket.ee website may contain references or links to third party websites. Baumarket OÜ is not responsible for the information contained on such websites or the services provided through them.
10.5. The product information is regularly checked and updated. The information may have been updated since your last visit. However, we recommend that you check the accuracy of the product information with our customer service team by calling +372 6 229 100 or by sending an e-mail to info@airmarket.ee before making a purchase, if possible.
